Punitive Damages

When a personal injury claim is successfully handled by an attorney, the compensation awarded to the plaintiff may include punitive damages. These are paid in addition to compensatory damages, which may include the victim’s medical expenses, wage loss, and pain and suffering. Punitive damages are awarded if the court determines that the defendant should be punished for their behavior beyond repaying the plaintiff for his or her losses.

Why Punitive Damages Are Awarded

Punitive damages are awarded in cases where the defendant’s behavior was especially reckless or egregious and they will not be legitimately punished by paying only compensatory fees. Most cases awarded punitive damages involve an individual versus a corporation.

For example, if someone was injured by a corporation’s toxic waste, but the claimant only receives compensation for their medical expenses, wage loss, and pain and suffering, the case may not provide the corporation with enough incentive to stop polluting the waters. Very often, compensatory settlements are cheaper than fixing the problem, and corporations will make more profit by writing checks to the people who suffer the consequences.

Punitive damages are intended to punish the defendant and provide them with incentive to correct the problem.
