A DUI manslaughter case in Florida has prosecutors requesting medical records for Billy Lane. His defense says that those records are protected by confidentiality laws while the prosecution maintains that the records, including any injuries that would be indicative of Lane being the driver, are necessary for their investigation. The trial is expected to begin in early 2008.  Billy Lane, according to police, had a blood alcohol level of 0.19 when his truck crossed a double yellow line in order to pass several vehicles and ended up striking 56-year old Sebastian Inlet park ranger Gerald Morelock's mini motorcycle. Lane faces up to 15 years in prison if convicted on the charges. The medical records sought by Assistant State Attorney Tom Brown may contain information regarding injuries that would point to Lane being the driver, statements Lane made about the crash including his description of it, and observations of Lane's physical appearance as made by medical professionals. Brown would also like the results of any blood test the hospital may have performed. Recently in Pennsylvania, a portion of Interstate 80 in the Poconos was shut down after numerous people failed to observe cars braking in front of them. Traffic was down to one lane for about an hour until the accident was cleared from the roadway. Four of the seven vehicles were capable of being moved without the assistance of a tow truck, but the other three had to be towed as they sustained front-end damage, according to the Standard-Speaker of Pennsylvania.  Despite the fact that there were 7 vehicles involved, only one person (a passenger in one of the rear-ended cars) was actually injured. The injured was Anthony Martucci of New York who sustained a head injury. Martucci was a passenger in the last vehicle to rear-end one of the other vehicles involved in the crash. Martucci was taken to a local hospital. The passengers in the other cars were not hurt. A Green Bay teenager must stand for a competency exam to determine whether or not he is able to stand trial for a tragic incident that occurred near downtown Green Bay recently. The Appleton Post-Crescent reported that the driver created serious danger during the Wisconsin automobile accident and caused injuries to a 12-year-old girl who was thrown from the vehicle he was driving. “Emmanuel Jennings of Green Bay is charged in Brown County Circuit Court with eluding an officer, hit-and-run causing great bodily harm, two counts of hit-and-run causing injury and one count of obstructing an officer stemming from the April 3 chase. Police began following a sport utility vehicle in a parking lot near North Broadway. Jennings accelerated out of the lot, jumped a curb, ran a stop sign and collided with a different squad car at Broadway and Hubbard Street, according to a criminal complaint.” These types of incidents are all too common. Everyone seemingly understands how dangerous it is to drink and drive, and most people heed the advice to simply not do it.  However, the problem is that even if you do not drive after drinking, you never know if everyone else on the road is following the law.  Tragically, the family of a Green Bay couple found out that at least one area man was breaking the law on August 27. 

The Appleton Post-Crescent reported that Richard Ware of Gillett pleaded not guilty to charges of homicide by intoxicated use of a vehicle and other charges.  Ware allegedly was driving drunk in an accident that killed James Tyndall and his wife, Laura.

“Ware’s car went into a ditch and hit a power pole, but he was not injured, according to the Shawano County Sheriff’s Department. The driver of the semi and his 11-year-old son, who was a passenger, also were not hurt.Ware is charged with two counts of homicide by intoxicated use of a vehicle, operating while under the influence and other violations. He entered his plea Monday in Shawano County Circuit Court, and a jury trial has been set for March 5.”
