Dr. Jack Levine is being sued once again, the fifth time in seven years. This time around the doctor is being brought to court after leaving a catheter in a patient’s chest.

Ralph Barcus has filed a suit against the doctor after suffering chest pains after his initial medical treatment. After seeking medical assistance of two other doctors, it was determined that his chest pains were the result of a piece of catheter that was left in his chest.

Dr. Levine has been brought to court many times during his time in West Virginia and now practices in Illinois. Applebee’s sued by a WVU student

Christopher Puccio filed a personal injury suit after he suffered a severe allergic reaction to his meal. He claims that the restaurant failed to properly clean the grill before preparing his food.

Puccio informed the server of his severe allergies to seafood when he ordered and he was told that his food would not come in contact with any surface that had touched seafood.

Puccio became ill and had to be taken to the emergency room for lifesaving procedures after consuming his meal. His injuries and illness caused him to miss considerable time at school, pain and physical disability, medical expenses, loss of enjoyment of life, and mental anguish.

Defective Brake Pedal leads to lawsuit

DaimlerChrysler and Cassens & Sons are being sued over defective brake pedals. Dorothy Haggard claims that her vehicle failed to brake, causing her to collide with another vehicle. Apparently, the brake pedal depressed into the accelerator, causing her to speed up rather than to slow down.

Haggard purchased the vehicle at Cassens and claims that the car was defective and unreasonably dangerous. The brake pedal mounting system was defective in design and collapsed when pressure was placed on it.

Haggard is seeking damages in excess of $300,000 for medical expenses, scarring, mental anguish, pain, and disfigurement.

Baby is dropped during delivery – medical malpractice suit filed

After being admitted to Memorial Hermann Baptist Beaumont Hospital for having signs of being in active labor, Sherri Bates was sent home by the hospital staff. Several hours later, Bates gave birth at home and claims that the baby “fell to the floor upon delivery.” She initially went to the hospital because she believed she was in labor. She claims that she was never properly examined to determine whether or not she was truly in labor and expected to give birth that day.

The malpractice lawsuit is filed against nurse Josi Rawls and Dr. Joanne Holder. The suit claims that Dr. Holder failed to do her duties as a doctor and was negligent in her actions. The doctor is being sued for failing to properly complete the needed tests to determine Bates’ pregnancy progress. The suit claims that Baptist Beaumont is liable for damages because nurse Rawls was one of their employees.

Bates is seeking damages for past and future mental anguish, impairment, medical expenses, and pain.

Dental Malpractice Lawsuit

A temporary fixed partial denture was placed in the mouth of Regina Hamilton despite the fact that a root tip remained after a tooth was removed. Sarah M. Thompson, D.M.D, is being sued by Hamilton for damages in excess of $100,000.

Hamilton claims that Dr. Thompson was negligent and failed to provide her the proper care. It is said that the doctor’s actions were careless and caused further pain to Hamilton’s teeth, gum, and jaw.

Dangerous sidewalk causes personal injury lawsuit

After falling outside of her home, Sharon Fulcher claims that her sidewalk is dangerous. A resident of Kirkpatrick Homes, which is run by Granite City Housing Authority, Fulcher claims that she attemtped to walk on her sidewalk when she tripped and fell. According to Fulcher, the sidewalk had an elevated section of concrete which caused her to lose her balance and fall.

She claims that Granite City Housing Authority was aware of the potentially dangerous sidewalk and did nothing to properly warn residents of the danger and did not take the appropriate steps to fix the elevated section of sidewalk.

Fulcher claims serious injuries as a result of her fall. She is suing for lost wages, pain, suffering, medical expenses, and loss of enjoyment of life. She seeks damages in the excess of $50,000.

Dishwasher’s skin problems blamed on bad training

The Dowlen Oaks Retirement Center is being sued by a dishwasher at their facility. Gary Stallworth, the dishwasher, claims his sensitive skin developed a more problematic skin problem after working for the Retirement Center.

The personal injury suit claims that Stallworth’s injuries are a result of the manner in which he was washing the dishes. He claims that the negligent acts of Dowlen Oaks include failing to provide proper training, failing to provide proper equipment, and failing to provide a safe work place.

Stallworth is suing for mental anguish, lost wages, impairment, medical expenses, and physical pain.

Memorial Hermann Hospital Under Fire for Medical Malpractice

Lester Thomas died of an infection at Memorial Hermann hospital shortly after an X-ray revealed that a nasogastric tube was lodged in Thomas’ right lung. The widow and daugther of Thomas are now bringing their malpractice claim against the hospital to court, claiming that they believe their husband and father suffered medical abuse while he was a patient at the hospital.

Patsy, the widow or Thomas, stayed by her husband’s side as he was admitted for a benign tumor in his rectum. A year after his surgery, a routine X-ray revealed a nasogastric tube sitting in Thomas’ right lung. Thomas died from pneumonia shortly after this discovery.

Patsy claims that the tube that was left inside her husband by doctors was the cause for his pneumonia and his eventual death. A nurse testified in court stating that she believed something was out of place with the patient after his surgery.

The medical malpractice suit seeks damages for emotional pain, Thomas’ pain and suffering, wrongful death, and survival damages.

Automobile Defects Suit: GM Liable?

Charles Davis, a resident of Kansas, filed a claim against GM after he discovered that his Trail Blazer did not have a stability control device. While Davis was driving his 2004 Trail Blazer over an icy bridge in January he lost control. His vehicle swerved all over the road and eventually rolled, causing Davis to suffer injuries. Davis claims that his vehicle did not have the version of an electronic stability control that had been placed in previous models of the popular Trail Blazer.

The electric stability control is used to help prevent loss of control when the vehicle swerves. Davis argues that GM did not meet the federal safety standards and regulations in the design of the 2004 Trail Blazer.  He suggests that alternative designs would have prevented his injuries as well as the damage to his vehicle. Davis is suing for medical expenses, lost wages, impairment, physical pain, and disfigurement.

Harvard study states that Malpractice Suits are not out of hand

Harvard University strives to improve public health through a study involving 1,452 closed medical malpractice claims from all over the country. The study concluded that medical malpractice suits are not “frivolous” at all. The New England Journal of Medicine published the study for public viewing. The study came as a response to politicians who deem malpractice suits as frivolous.
