Defective braking and steering causes Cavalier owner’s injury

General Motors Corporation and Steve Schmitt Motor Company are being sued by Herbert L. Cline after he experienced dangerous problems with defectively designed steering and braking systems in his Chevrolet Cavalier.

Several days after purchasing his 2004 Chevrolet Cavalier, the car went out of control as the steering and braking system stopped working properly. The defect caused him to swerve out of his “intended path of travel” and strike a cement median wall. This collision caused the airbags to deploy and caused the driver even further problems regaining control of the vehicle. Finally, the car came to a stop on an embankment.

Cline claims that the manufacturers were negligent and failed to adequately inspect the vehicle’s defective design before it was released into the market. He also claims that there was not sufficient warnings provided about the potential dangers of his vehicle.

Cline is seeking damages in excess of $400,000. He claims to have suffered severe injuries and seeks damages for physical and mental pain, disfigurement, disability, loss of enjoyment of life, medical expenses, and emotional distress.

Med Mal Lawsuit in St. Louis

Two years ago, Janet Orschell, passed away after suffering medical complications and hypovolemic shock. Her husband, Clarence Orschell, has now failed a medical malpractice lawsuit against the medical centers allegedly responsible for her death. These centers include Vascular and Hand Surgery, Ltd., St. Louis University, Dr. Roland Mawis, and St. Elizabeth’s Hospital.

Orschell claims that the medical staff and doctor failed to properly diagnosis his wife’s hypovolemic shock and did not treat her for it in a timely manner, resulting in her death. Had the order been made for “a type and cross match of packed blood cells” been made in a timely manner, his wife might still be alive.

Faulty switches on F-150s XLTs lead to lawsuit

Gary Medrano has filed a lawsuit against Ford Motor Company after his 2000 Ford F-150 XLT caught on fire due to a faulty cruise control switch. He claims that the fire department that finally ended the fire told him that the fire was caused by a defective cruise control deactivation switch.

Medrano claims that he was not able to get any help from Ford. He states that the speed control deactivation switch was located in circuit that is constantly powered, no matter if the vehicle is parked or even turned off. The faulty switch also did not have any mechanism to switch it off if it begins to overheat.

He is seeking damages for the monetary loss of purchasing the defective truck, the destruction of his vehicle, property damage, and physical injury.

McDonald’s burger causes chipped tooth

William Mucklow filed a personal injury lawsuit against McDonald’s Corporation and Macatac Winfield Inc., after he chipped a tooth on a bone that was left in his hamburger.

Mucklow claims that his burger contained “a hard non-food substance believed to be bone.” He did not notice the suspected bone until it was too late and he had chipped his tooth after taking a bite from the burger.

He claims that the defendant failed to provide safe food products and was negligent in inspecting their food before serving it to the public. He claims that the McDonald’s Corporation “supplied, sold and transferred the defective and unsafe food products into the State of West Virginia.”

Mucklow is seeking compensatory damages as well as court costs and attorney fees.
