Seattle Symphony Player Loses Lawsuit, Plans Appeal

Violinist Peter Kaman’s personal injury lawsuit against the Seattle Symphony, in which he alleges emotional distress caused by an intentionally hostile environment and prolonged harassment, was dismissed this month in King County Superior Court. A statement by Seattle Symphony publicist Rosalie Contreras praised the ruling and said it proved that the evidence was in favor of the symphony.
Kaman, however, was not deterred by the ruling. He claimed that his case was dismissed solely on procedural grounds relating to the statute of limitations, and not because of lack of evidence. Kaman, who is currently on 90 days of sick leave, said that he agreed with the judge’s ruling on procedure, but plans to continue his fight “for what is right.”

Stamina Products Pays $100k Settlement

Stamina Products, of Springfield, Missouri, agreed to pay out $105,000 as part of a settlement over its allegedly defective mini-trampolines. The charges, brought by the US Consumer Product Safety Commission (CPSC), accused Stamina Products of violating federal law by failing to report known defects in its trampolines in a timely manner.
Between April and June of 2005, Stamina products received reports from eight consumers saying that the trampolines sprang back when opened, causing facial lacerations, bruises, broken teeth, neck pain, and broken facial bones, among other things. The CPSC was not notified until July 2005.
Stamina Products issued a recall for some 670,000 trampolines in April 2006.

Medical Malpractice Ruling will cause changes

Judge Diane Joan Larsen of Illinois ruled that the 2005 Illinois medical malpractice reform bill is unconstituational. This ruling did not come as a shock, but will have an impact on malpractice law none-the-less. After taking a closer look at the 1997 Supreme Court decision in Best vs. Taylor Machine Works, Larsen could not supercede the Illinois Supreme Court. This is not to say that the decision has not caused any change.
Texas has seen many civil reforms, including limits on non-economic damages. This type of reform has led to increased job growth and economic benefits for the state.

Premature surgery lawsuit

Darlene Spears filed a medical malpractice lawsuit against Dr. Carl Beaudry after she was taken into surgery too early. Spears states that she was infected with a pathogen that could have caused her a great deal of harm. She claims that if Dr. Beaudry had waited for her to recover from the infection, her injuries that followed the surgery would not have occured.
She claims that Dr. Beaudry failed to obtain informed consent and did not properly diagnose her infection before preforming the surgery. The lawsuit did not include specifics on Spears’ condition post-surgery, but does claim that she was not diagnosed properly before she was placed on antibotics.
She is seeking damages for medical expenses, disfigurement, pain, and mental anguish.
