Driver Pleads Guilty in Death of Girl

Posted on Thursday, March 5th, 2009 at 3:39 am

A Colorado driver who hit and killed a 9-year-old girl while talking on her cell phone has pleaded guilty to the crime.  Michelle Smith was charged with misdemeanor reckless driving resulting in death.  Erica Forney was riding her bike when Smith's SUV fatally struck her.  According to police, Smith was talking on her cell phone at the time of the accident and failed to pay proper attention to her surroundings.

Smith was sentenced to two years probation and 150 hours of community service.  In addition, Smith will give money to charity and complete a driving class.  Lastly, she will be required to write a letter of apology to the Forney family, which will be published in the local newspaper.  Under Colorado law, Smith could have received up to one year in prison.

The Forney family said they hoped that Smith's actions would increase awareness and lead to more responsible driving in the future.

As this case demonstrates, it only takes a split second for a serious accident to occur, and the consequences can be devastating.  If you or someone you know has been involved in an automobile accident, contact the Green Bay personal injury attorneys of Habush Habush & Rottier S.C. ® at 800-242-2874 to schedule a consultation.
