Family wins $2.25 million in nursing home negligence wrongful death suit

Earlier this month, The Willows Nursing & Rehabilitation Center in Sun Prairie, Wisconsin settled a wrongful death nursing home malpractice lawsuit with the family of 72-year old Cynthia Wilms.  The Willows, named as the worst in the country, will pay the family $2.25 million plus an undisclosed amount for costs related to the suit.  The settlement is the largest between a nursing home resident and nursing home in Wisconsin in history.

Wilms went into The Willows after having an elective hip replacement surgery to rehabilitate.  Wilm's condition worsened as a surgical wound from the hip replacement became infected.  No employees at the chronically understaffed nursing home did anything or contacted anyone to help Wilms get better despite knowledge of the staph infection.  A month and a half after entering the nursing home Wilms passed away.

 

 

12-year old killed in bicycle accident

Yesterday evening, a 12-year old Shawano boy was seriously injured while riding his bicycle along Lark Road in Waukechon.  

Joe Yoder was riding his bike just outside of Shawano when he was hit by a truck at 5:25 PM.  Emergency crews transported the boy to Shawano Medical Center for critical injuries.  He was later airlifted to St. Vincent Hospital in Green Bay.  Today, medical officials decided to transfer him once more to the Children's Hospital of Wisconsin in Wauwatosa.

Yoder succumbed to his injuries and passed away at 1 AM this morning.  Shawano County police are investigating this tragic bicycle accident.

24-year old killed in ATV accident

A 24-year old man from Lena was killed Saturday evening around 8PM in a tragic ATV accident.  The accident occurred at the intersection of North Branch Road and Spreeman Road in Breed when the ATV collided with a van.  

Officials from the Oconto County Sheriff's Department believe that the driver of the van failed to yield before trying to turn left onto Spreeman.  Officers also believe that the driver of the ATV was speeding.  The driver of the ATV was transported by emergency officials to a nearby hospital where he was later pronounced dead.  He was wearing a helmet and protective eye gear at the time of the crash.

Ford pays $131 million for defective seat belt

After 11 out of 12 jurors agreed that Ford Motor Co. was at fault for the car accident that left 22-year old Brian Cole dead, they agreed to a settlement with the minor league baseball player's family.  Ford agreed to pay $131 million to the family before the jury could decided on any punitive damages.

Cole, a New York Mets AA player, was returning home from spring training in March, 2001 in his Ford Explorer Sport, when it veered off the Florida highway and rolled over.  Cole was ejected from the vehicle and incurred serious injuries, which he later succumbed to at Saint Luke's Hospital. 

In the case, Cole's family alleged that the Ford Explorer he drove was unstable and did not perform to the way in which it was marketed.  Additionally, they believe that there was sufficient evidence that Cole was wearing a seat belt at the time of the accident, and that the Ford's defective seat belt failed to prevent him from being thrown from the vehicle.   

Ohio couple sues physician and practice for failed treatment

An Ohio couple, Sara Tschop and her husband Kenneth L. Tschop Jr., have filed a medical malpractice suit against Dr. Linda Savoy and University Physicians & Surgeons in Huntington, West Virginia.  

Sara Tschop went to see Dr. Savoy on May 5th, 2008 with pain on her left side and back and nausea.  Savoy and technicians at University Physicians & Surgeons administered a CT scan which revealed "bilateral non-obstructing renal calculi and mild left hydronephrosis".  Tschop then had two follow-up appointments in May and June where Savoy prescribed a narcotic pain medication for the renal stone.  Savoy also referred Tschop to an endocrinologist for further evaluation.

Tschop later saw a urologist and underwent multiple surgeries for the stone.  In March 2009, almost seven months after her surgery, test results showed that her kidney was only functioning 6.6 percent.  In May 2009, Tschop had to have her non-functioning kidney removed through a robotic laparoscopic left nephrectomy.

The Tschops argue that Savoy and her practice failed to properly treat and monitor her left kidney stone.  In addition, they believe Savoy failed to refer Sara to a urologist in a timely manner.
