Payment amounts increasing in surgical malpractice claims

Posted on Monday, November 14th, 2011 at 11:47 pm

While medical malpractice claims filed against surgeons and surgical residents have decreased over recent years, payment amounts from these types of claims are increasing, according to a recent study.

The study analyzed data from 58,518 surgical malpractice claims filed from 1990 through 2006 from the National Practitioner Data Bank.  The highest payment amounts came from claims filed in Wisconsin, Illinois, Delaware, and Connecticut.

Between 1990 and 2006, researchers found that claims filed against surgeons decreased by about 154 a year.  Researchers also found that the pay-outs on these claims increased by about $3,200 a year.

The majority of claims against surgeons involved improper performance or improper treatment.

Teen settles dog bite case for $210,000

Posted on Friday, November 4th, 2011 at 6:13 pm

A Wisconsin teen recently settled a dog bite lawsuit with St. Croix County and the Hudson Police Department for $210,000.  About $110,000 of the settlement was given for medical expenses and attorney’s fees and about $100,000 was given for damages.

The 17-year old Hudson boy was bit by a police dog about 2 years ago.  According to the lawsuit, the teen was running from a home where shots were fired when the police arrived and released the dog on him.

The teen and his mother argued that police used excessive force by releasing the dog onto him.  The boy suffered permanent injuries to his arm from the dog bites.
