How do I determine if someone is at fault?

For someone to be at fault for your injury there must be proof of negligence on the part of the individual that caused the injury. You must be able to show a) the existence of a duty owed to you by the person that caused the injury; b) the other person failed to carry out that duty; c) an injury or damages were caused; and d) the person’s failure to carry out his or her duty caused your injury.
