After being admitted to Memorial Hermann Baptist Beaumont Hospital for having signs of being in active labor, Sherri Bates was sent home by the hospital staff. Several hours later, Bates gave birth at home and claims that the baby “fell to the floor upon delivery.” She initially went to the hospital because she believed she was in labor. She claims that she was never properly examined to determine whether or not she was truly in labor and expected to give birth that day.

The malpractice lawsuit is filed against nurse Josi Rawls and Dr. Joanne Holder. The suit claims that Dr. Holder failed to do her duties as a doctor and was negligent in her actions. The doctor is being sued for failing to properly complete the needed tests to determine Bates’ pregnancy progress. The suit claims that Baptist Beaumont is liable for damages because nurse Rawls was one of their employees.

Bates is seeking damages for past and future mental anguish, impairment, medical expenses, and pain.
